I was in a pre-trial last week over an option agreement with my personal injury lawyer who never studied about offer, acceptance and consideration. The Judge said, “Dan, would it be fair to say an option is the right to buy something at a future time at a set and agreed upon price?” Dan looked slack jawed, looked at his assistant, looked back at the judge and said “Brilliant your Honor, brilliant!” I was hoping the judge would pull out a gun and shoot Dan but instead gave him leave to amend.
