The use of deadly force to prevent the escape of all felony suspects, whatever the circumstances, is constitutionally unreasonable
That decision was only meant to stop the indiscriminate use of deadly force when apprehending ANY fleeing suspect.

Same judge also concluded the following:
A police officer may not seize an unarmed, nondangerous suspect by shooting him dead
If the perp, however, represents a clear and present deadly threat to the safety of the officer or to the public, then it is the duty of the officer to stop that threat.
