You mean unrecognized, but I get what you're saying.

The problems are so extensive that could never happen. You get into such diverse areas as estate/gift taxes, tax basis calculations, depreciation of course capital assets, wherewithal to pay -- all fundamentals of taxation. But the big problem is if you're going to hit Elon with $10 Billion in taxes, he has to have a way to pay it so are you going to force him to sell his stock?

A more likely scenario is you'd see them tax it all as ordinary income, eliminating the capital gain treatment altogether. Which brings you to this scenario I wrote about years ago on this thread:

Let's just hope they tinker around the edges but leave the core issues alone!
