That's not it. In one case your dealing with a very flagrant abuse of SEC Rules - the selling of unconverted REG S share so as to depress the market price in order to increase the number of shares you are eligible to convert before the required holding period for the convertible debentures has expired. Here it is not naked short selling, since you actually have the ability to cover the higher market price short sale with cheaply converted stock. In the case of OVIS/RMIL you are dealing with a fantasy called "illegal naked short sellers" who in reality are market makers exercising their right to short stock in which they make a market. These short shares are usually covered either in the same trading day or within a few days of their origination. Are there other short positions existing in OVIS/RMIL? Probably. Are these positions anywhere near as extensive as some on this thread would like you to believe? Most unlikely IMO.
