the order invites a legal fight with high-stakes consequences for public health that the government may well lose.

Always an error when you see something like this... when they are picking the fight they are... particularly while doing everything it is possible to do to lose, even providing a roadmap showing how they should lose the fight... to assume they ever intended to NOT lose the fight... rather than lose it on purpose ?

Politically problematic (if in different ways) for Democrats and Republicans both... to vote for... or vote against... what can only be bad policy, which ever way you take the legislative effort... Either it is fiscally unsound and does great violence to people... and the market... or it is fiscally unsound and does great violence to the Constitution and the rights of property owners...

Whatever you choose... it is bad fiscal policy... bad public policy... bad for people, and bad for the market...

So, what should be done... and what has to be done... has nothing to do with it... as it will become all and only about politics and the need for politicians to avoid taking responsibility for those problems they have imposed.

So, they will have to craft something in a policy that is so bad... and does such immediate violence to the law... and to people,,, that the courts won't allow it... thus making whatever happens not the fault of the legislators... but the fault of the courts... "They made us do it"... so, vote for me... since I opposed it"...
