I suppose you could make the same one-size doesn't fit all point regarding assault too.

I could and did. I was on a jury a few years back. A young man was charged with assault. The testimony, excluding those witnesses we didn't believe, indicated that he did not want any part of what was going on in that house and pushed someone who was standing in front of the door out of the way so he could get out. We found him innocent (which is rare, such things usually go to hung jury and new trial).

I learned later that half the people in that altercation were police plants and the whole prosecution was a way to force the defendant into some kind of deal where he testified about other people there. No angels there, but no assault either.
