The patriot act is a shitty law, but , as an Act of Congress, is perfectly constitutional -g- in fact, if the vaccine mandate were issued by Congress it, too, would be perfectly constitutional. Since it was not, questions arise, and lawyers armed with case law will work it out. Alternatively, Congress issues the mandate and all folks fighting it are SOL. When the country goes to war, one expects a draft. The benefit is you get a nice gun to shoot the motherfuckers that invaded your country. The drawback is they, too, have guns. When a country gets a pandemic, one expects vaccine mandates. Stupid in some cases (e.g., a person had CoVid ), but what can you do. If you can dodge a draft, you can dodge a vaccine mandate?
