If it is real, it is egregious and unconscionable breach by a justice or his/her clerks to leak a draft opinion.

“ No draft decision in the modern history of the court has been disclosed publicly while a case was still pending. The unprecedented revelation is bound to intensify the debate over what was already the most controversial case on the docket this term.” Could it be that one of the liberal Justices (or someone on their staff) leaked the draft opinion in an attempt to stir up public opinion and outcry in an attempt to change the vote? Watch for the pro-abortion crowd to go crazy over the coming weeks.
