Brendan-I have the luck of the Irish-Murphy's Law, that is. I have the good or bad fortune of owning stock in IOM, EGRP, and OMGA and each Company is facing a class action. When the litigation against EGRP began I wrote many messages to thefool.com board advising how one could intervene and advise the Court that the suit was hogwash. All a stockholder need do is get the Court's address and send a letter to the Judge expressing your thoughts. Sending an e-mail to the Plaintiff's attorney will not do much good if you oppose the litigation. Sueing Companies who are traded must be in vogue. I truly believe there are times when a class action is necessary such as the breast implant actions. In that circumstance an individual would be overwhelmed by a company such as Dow. I filed one class action in my legal career against the State of Michigan for seeking to impose state income tax on people who had won the lottery prior to the law's passage. It was successful and 4000 of my clients are pleased that I filed the action in behalf of Doctor Jim Shay and all others in his circumstance. My partner and I were also happy!!! Our fee was contingent. i.e. 1/3 of what we saved each client for one year's income tax. Jim Shay owed over $40,000 for that first year. I was shopping at a local grocery when Jim Shay stopped me and said "Ron, can the state charge me income tax on my lottery winnings when I won prior to the state passing that law." I responded that I did not think so. On Monday, Jim came into the office and that afternoon we had the action filed in Michigan's Court of Claims as a prospective class action. Jim had been a friend for years and had his own attorney (not me) who told him he did not have a cause of action. I was so pleased that I should send that attorney a yearly gift for his advice which lead to my grocery store conversation with Jim Shay who was shopping for his wife even though he had recently won some 34M. No more dentistry for Jim. Sorry to take so long at getting to the point which is most lawyers are decent people and not the grubs you and I complain about.Let us not paint a group with a broad brush. I mean, we could say all Presidents cheat on their wives, or all priests pick on little boys, all doctors are in it for the money, and on and on. If you think this litigation is bull then write to the Judge and express your opinion as a stock holder.By the way, in Michigan you could not file a class action if you did not have a client.
