I have been taking lawyer jokes for 36 years and enjoy
them as much as anyone.

What my observation has been is that lots of people do
not like lawyers except when it comes to their personal
lawyer and in that circumstance their lawyer is the best
thing since sliced bread - chopped chicken liver - grits-
and strawberry short cake.

To file a class action you have to have one client who is
the plaintiff. You then say to the Court that you believe
there are many people in the plaintiff's circumstance who
would like to be a party to the proposed class action.

In Michigan (I can't speak for the other 49 states) the Judge
would then conduct a hearing to determine whether or not your
case would be the type that should be a class action. If the
Judge says yes then he/she certifies the case as a class action
and the plaintiff's attorney notifies all parties who might be
interested in becoming a plaintiff.

If you receive a notice it will permit you to join or opt out as
you see fit. The persons who would be eligible would be those
holders of IOM during the dates specified in the notice.

There is always the possibility that a Judge may conclude that
the claim does not constitute a class action. In this particular
case I have no idea what a Judge would do as I am not privy to
the information they claim violates the law and for which they
seek liability.

Based on where IOM has gone today I would call it a knee jerk
reaction. The king sneezes and we get the cold.

My rule is simple - I have already been to hell and back - so if
Iom falls flat on its face and must pay lots of money to wronged
shareholders so be it. It hopefully will be the result of the
application of justice to the facts.

I do not think any lawyer would file a case against a company of
Iomega's stature with the thought in mind that Iomega will enter
a nuisance settlement to make the case go away.

The so-called nuisance settlements are something from the pipe
dreams of the insurance industry.

P.S. I cannot understand why you are telling lawyer jokes when
Clinton is such a better target and he gives us something
new just about each and everyday. I am still laughing over
his not inhaling. I mean, I believe. It is like the guy in
Stalig 17 who has been there for two years and says "what does
she mean I wont believe?" She was pregnant and he was the father!
Like I said, there is so much out there for brother Bill. My
wife says they don't call him Slick Willy for nothing.
