KE and crew should probably refrain as much as possible from commenting on the lawsuit. Bringing additional attention to the issue will only serve to delay the period of time needed for investors to file away the topic.

In addition, any attack-like response could be viewed negatively by those who've seen a stock they own drop due to similar conditions, (and almost all of us have experienced this at one time or another).

I think that most common sense individuals reading the press releases will see that the issues of a delayed product launch and plans for increasing an advertising program will certainly impact the price of the stock, but are hardly cause for a lawsuit.

It will likely take years to totally resolve the complaint. It will not quickly go away and will show up in future SEC filings and CC transcripts. Progress will be very slow, but investors will soon move on to current concerns.

IMO, the lawsuit is already old news, a nonsensical non-issue, and will have only the very shortest impact on the price of the stock.
