NASD says Morgan Stanley to pay fine, settles case

fined Morgan Stanley & Co. Inc. $35,000 to settle charges the firm failed to get the best price for three customers who sold
shares in Netscape Communications Corp. (Nasdaq:NSCP)

The firm was also ordered to pay more than $80,000 in restitution to the customers, NASD Regulation Inc. said Tuesday.

In reaching its settlement, Morgan Stanley did not admit or deny any wrongdoing but has agreed to promptly repay the three
investors the restitution and interest, the NASD said.

Officials at the firm's parent company, Morgan Stanley Dean Witter, declined to comment on the NASD settlement.
