I'm not sure, but I believe the refiners bid on buying it.

I million barrels a day has kept the inventory levels (excluding the SPR) from declining more than they have already. The components of the crude complex dance around, but generally they are all below the last 5 year average lowest levels. From what I've read the greatest shortage exists in the distillate category. Diesel and fuel oil.

The SPR is most likely filled up by bids on the Gulf of Mexico deep water drilling. Companies bid for the sections they believe to be best and pay for winning the bid by contributing to the SPR at the going rate I think.
