The federal government takes priority over the states. And the supreme court has upheld that. Perhaps you want to do some more reading. I assume you're referring to the The Supremacy Clause; if so, you're misunderstanding its applicability. The important point here is that you have a find a controlling law at the federal level for it to apply to for the Supremacy Clause to apply. I'd recommend a good reading of The Supremacy Clause and some good explanations of it; else, perhaps someone else will help out with it.
