My wild guess is that Intel is holding such a patent infringement suit until IDT ships sufficient C6/C6+ so that they could claim a fatal compensation to put IDT out of business to scare away any company from entering x86 processor business.

It would be stupid to underestimate the intention of the evil empire.

"What happens to IDTI and the C6 when Intel sues them for patent infringement?"

Perhaps the FTC slams Intel with anti-trust action? It is not clear that an instruction set is intellectual property. In the absence of any specific patent violations, Intel would be taking a huge risk by litigating against a small competitor.
