O'Leary may be indicted for aiding and abetting a fraudulent enterprise, making him liable for restitution. The old maxim is "go after the money", and O'Leary has money. In my opinion, O'Leary should be sued into bankruptcy with all assets siezed and sold to paid to FTX investors.
