I've done a little more research into these trademark issues you've raised. Generally speaking, a registered trademark is indeed subject to a "use it or lose it" limitation. The reasons for this are practical--companies are not allowed to monopolize names or other types of marks that they have never used, don't intend soon to use, or have "abandoned." Otherwise, every conceivable trade name or mark could be tied up by imaginative filers whose only activity would be to register names, or by companies who have no further need of the mark for various reasons, or who never really vigorously commercialized it. The Asics TM for Next Level, from what I read here, was in use in 1992. I've looked at Asics' recent on line product catalog, and I see a lot of trademarks used (they have a line that uses the word "GEL" in various ways), but no present use of the TM "Next Level." This may be why our Next Level can use this without undue concern (there may also be a license). Don't have all the answers, but I hope I've advanced the ball a bit.

Oh, I forgot. I find no very recent mentions of Mr. Holcombe in the trade press (unless I'm missing something). The last time I see him quoted or mentioned in an article is from 1996, and he was then with Rockport.

I read "somewhere" that you are really good at DD. If this is the case, then why do so many of the sentences in your posts end with a question mark? I would expect from a real DD man like yourself, the answers, not the questions. It takes a real tough, dedicated individual to provide the answers. Any fool can keep repeating the questions. All your questions show is that you are, once again, clueless. Please find something else to do with your time until you get a clue, OK? When you have something to add, you are welcome back. However, with your history, that will be a long time.
