First the recent story is
an unconfirmed report from TAIPE The Taiwan market
has been up and what better way to squash the market then to release a
bogus news announcement. The strategically placed news
was more then likely drummed up by a brokerage firm who is posed to lose
millions this week. The strategically placed news from
TAIPE was written to try to offset the very damaging U.S. Press Barron's
article written on Saturday about MU. Desperate
brokerages and banks that at this point risk losing a lot of money if MU
post's those -.30 earnings will try anything.
By Tuesday, these reports will be confirmed or denied. Now let me tell
you the facts. The U.S. Department of Commerce can
recommend anything they wish! It would be like me telling you I
recommend Clinton resigns and I am Republican. It does not mean
Clinton will go! The bogus news is bogus because everyone in Washington
knows the Department of Commerce has no jurisdiction in this
matter! Only the U.S. International Trade Commission can make this
happen. Again the bogus story remains bogus because their have
already been preliminary hearings on the matter and the outcome looks to
be just the opposite of what was falsely made up today! No
decision will be made on invoking any tariffs while the MOF and IMF
issues are on the table and the Asia regain continues to fall.
Any final decision will be postponed to late 1998 and do not count on
any decision that will invoke such tariffs. Because for as
many companies like MU that want tariffs there are hundreds more that
want free trade because they are able to buy cheap computer
components. Also, if any tariffs are applied you can be rest assured
that Taiwan will find another way to "skin the cat". They will ship
thru Japan or China or for that matter Hong Kong under a different
label, everyone knows this. There are more loop holes around
these bull shit tariffs then the U.S. tax code. Also, lets not forget
Taiwan only become MU's problem after South Korea slowed.
Now South Korea is back in full production and will be able to easily
replace any market share Taiwan might lose.
ú Under section 337 of the Tariff Act of 1930: MU will get nothing the
U.S. Government makes all the money as Tax Revenue.
ú Also just like with any other Final legal decision the entire legal
process at the end of March can and will be appealed. Maybe sometime in
the year 2000 or later a tariff will be applied.
I am in the legal business and now the Tariff Act of 1930 very well.
