Ben--I will not drop it. I am long on this stock; but I intend to find out about the risks as well as the opportunities. I also will express my opinion just like you will express yours. When there is a contingent liability on this company like this; without anyone knowing all of the facts; then you cant say this is going up just because you want it to. I want to see the downside as well as the upside. Big contracts coming--good. However, if the settlement is open ended and not fixed at $8.5MM then you are not considering the down side of owning it. When someone proves to me that the maximum liability is $8.5MM; then I'll drop it.

Many thanks for the info. As part of the class action suit against Sapiens I have been included (by the lawyers in the case who would really be the big winners and not the actual plaintiffs!) in the first class action (the 8.5 million settlement). I did not receive any other letter/info on the Porter case but rather just a letter last October that the distribution of the settllement will not take place till end of April. I will definitely look into this. The law firm that you provided differs from the one I have (unfortunately all my Sapiens law suit documents are at work and I dont remember their name but will post it tomorrow. It is a very distinct and long name but hard to remember!).

In any event I can not wait till April to see how much and in what form the judge in the case is going to decide to distribute the settlement once and for all and have this last remaining cloud clear over Sapiens. I was hoping to receive a combincation of cash and stock, but if they have already liquidated the stock assigned to the case it seems I am just going to be getting all cash (which I really do not mind but preferred it to be in the form of stock and cash).

According to these guys the judge assigned to the case will make the decision by the end of April 1998 on how the $8.5 judgement is going to be distributed among all plaintiffs (i.e. all investors who bought the shares of SPNSF between 1993 and 1/1995).

When you call you need to tell them you are calling in regard to Sapiens Securities litigation. Usually they send you to someone and you have to leave a message for them. But they never get back to you (they seem to always be very busy handling other cases)! But if you insist you need to talk to someone in person they will respond to you properly! I have two names who were assigned to the case (from last year) but dont know if they are still handling the Sapiens case anymore or not: Bill Markwood, and/or Dan Galoger.

If anyone calls and finds out anything new I'll appreciate it to share it with the rest of us.
