Well, here is some interesting news for the upcoming CTIA. Seens W-TDMA is going to be pushed after all. Who is involved, none other than Ericsson.

I searched around in cdg.org but I couldn't find any quote about that CDMA wouldn't work.Then there are comments about the advantage of CDMA
compared to other system and that is a completly other business.But
enough about that.It's history.

I have some comments about your post.

IS-95 is using the network structure of IS-41 which is the standard used by the US analog and TDMA systems.So none of IS-95 or GSM is using a "CDMA infrastructure".My opinion is that the
GSM network structure is superior to IS-41:s.This is one of the
main reason why GSM is so successful around the world.
About IPR:s.It is probably very difficult to make a WCDMA system
without stepping on QCOM:s IPR:s.But I don't think QCOM should overplay their hand.In the W-CDMA system there is probably thousands of patents involved.IS-95 and QCOM is using the signalling interfaces
of IS-41 without saying sorry.They haven't been involved with the
research in that area.Ericsson and Lucent are 2 of the most important
players there.I don't know how much Dr Viterbi gets for his encoding
patents used by for example GSM.There are hundred examples like that.
I don't know how unique QCOM:s patents are compared to all the other
ones used in WCDMA.A question for this thread.What is the timespan
of the validity of the patents in this area? Does QCOM have this
patents forever?

I like to answer your question about any advantages with W-CDMA
compared to IS-95.
1. The most important.W-CDMA will not be owned by any company.No
big licensing money to be paid.
2. Built on GSM network structure.
3. A newer standard.10 years of experiences with IS-95 has made it
possible to come up with better solutions in a couple of areas.They
will for example use mobile assisted handover for hard handover.
I know.All this stuff can be put in to a IS-95 system also.But then
it will not be backwardcompatible with older mobiles.Thats the problem with changes in the airinterface.
