RE: INMD Potential of patent infringement settlement - An Extra LOTTO Ticket!

(Maybe worth $1.50/share if INMD Wins their case; could be twice that at the high end of BARD's estimate)

an estimate of the potential settlement value for InMode (INMD) in their patent infringement suit against BTL Industries, Inc. (d/b/a BTL Aesthetics):

Estimated Settlement Value

Based on a review of similar patent infringement settlements from the past five years, it is estimated that the potential settlement value for InMode could be between $50 million and $250 million. This range is based on the following factors:

  • The severity of the infringement: In the present case, the alleged infringement involves two of BTL's flagship products, the UltraFemme 360 and EmFemme 360 devices. This suggests that the infringement could be considered significant.
  • The potential damages to InMode: If BTL is found to have infringed the patent, InMode could be entitled to substantial damages. These damages could include lost profits, royalties, and punitive damages.
  • The strength of InMode's case: InMode's patent appears to be strong, and the company has a history of successful patent litigation. This suggests that InMode has a good chance of prevailing in the case.
Factors that could affect the settlement value

The actual settlement value could be higher or lower than the estimated range depending on a number of factors, including:

  • The outcome of the litigation: If InMode prevails in court, the settlement value is likely to be higher. However, if BTL prevails, the settlement value is likely to be lower.
  • The willingness of the parties to settle: Both parties may be willing to settle the case to avoid the costs and uncertainties of litigation. However, the parties may have different expectations for the settlement value, which could make it difficult to reach an agreement.
  • The size and financial strength of the parties: BTL is a large and financially strong company, which means that it has the resources to pay a large settlement. However, InMode is also a well-funded company, which means that it is unlikely to accept a low settlement.
Conclusion

The potential settlement value for InMode in their patent infringement suit against BTL is significant. However, the actual settlement value will depend on a number of factors, and it is impossible to say with certainty what the outcome will be.

INMD I think the stock was discovered and abandoned perhaps when growth was not what the momentum boys were seeking. the stock hit $90 briefly a few years ago. I may be missing something but I am really not seeing much downside risk to a company that has solid cash flow and lots of the cash on it s balance sheet and patent protection. the company is in a position to subsidize some of the finance costs of clients who purchase their machines my like the homebuilders do for home buyers.
