If those companies had a Profit-sharing plan, they could make it vest for employees after 6 months of employment, and after an I-1 is filed, and not for those not eligible.

As could companies in Tennessee, and as could Tesla (if it has any TN employee), for employees eligible for an ESPP, or for stock options, and not allow non-employees or non-citizens without a SS number or an EI Number.
I think that story is not complete.
