FACTCHECK: A NYC Jury Exonerated Trump in Determining he did NOT Rape E. Jean Carroll

Without going into the merits of E. Jean Carroll's rape claim against President Trump I thought it was worth explaining what exactly the jury decided.
After hearing all of the evidence the jury did NOT find Carroll's claims that Trump raped her credible. Since this was a civil trial they only needed to determine her claims were more likely true than not - only 51%. In a criminal trial they would need to determine her claims were true beyond a reasonable doubt - 90%+. This makes it clear they did NOT believe Carroll's claims.

During the jury instructions the judge explained to the jury that to find Trump liable for 'sexual abuse' they need not determine he did anything more than give her an unwanted kiss on the cheek. The jury form did not inquire as to what sort of 'sexual abuse' the jury determined Trump committed. Had the judge wished to determine what exactly the jury believed he could have included additional questions. Here is what he said and what the jury decided:

Instead, the judge decided, on his own, that despite the juries determination that Trump did not, in fact, rape Carroll they must have assumed he digitally penetrated her with his fingers and under criminal statutes that would have been considered rape. The jury did NOT make this finding and the judge's instruction explains why.
So to say that a jury found Trump liable for rape is inaccurate. The only thing you can say is that the jury determined Trump was liable for some sort of undefined 'sexual abuse'. Only the judge who was not on the jury or in the jury room is making that claim. I contend that if the jury thought Trump raped Carroll it would have found him liable for rape.
