Perhaps all that work explains why you didn't notice that in the trial the judge and jury were dealing with rape as defined by NY law, the case being a criminal matter, while the judge's use of the the word in his comments explicitly and directly differentiated as the common parlance, dictionary version, which is:

noun

  1. unlawful sexual intercourse or any other sexual penetration of the vagina, anus, or mouth of another person, with or without force, by a sex organ, other body part, or foreign object, without the consent of the person subjected to such penetration.



Both usages are valid. But it takes both critical thinking and a good-faith effort.
