I don't know. I think higher courts do not like override jury awards. But given the jury didn't even agree there was a rape, who knows.

Personally, I'm unclear on how this violation of the statute of limitations holds water. It looks like targeting to me and I wonder whether it wouldn't have been a case to bring before USSC. I was surprised Parlatore wanted him to settle it to get rid of it.
