It's a First Amendment right to protest outside the Capitol. There are dozens of major protests each year there. Many are led by politicians and others fighting for policy changes and political upheaval. None are insurrections, especially Jan 6th where not a single firearm was used by a protester. How can you have an insurrection without guns? Answer is, you can't. Did it turn into a riot, unfortunately yes. But insurrection? Get real.
