Sure there is. She testified it happened. He declined to challenge it under oath. Therefore, there is evidence and there is nothing to contradict it.

Unless 'evidence' is yet another word you don't know the meaning of.

Now I might be wrong as to the status of testimony under oath, but AFAIK, it counts as evidence.
