AOL access case settled

A judge in Chicago today approved a class-action
settlement in a lawsuit filed by America Online
(AOL) subscribers who had trouble accessing the
online network last year.

The settlement, which some attorneys had argued
would benefit only a small number of the 8 million
class members, was approved by Cook County
Circuit Court Judge Stephen Schiller.

The lawsuit was filed when some subscribers found
they had difficulty accessing AOL's network after
the company decided to offer a flat monthly fee for
unlimited use.

The settlement provides refunds based on the plan a
subscriber used and the amount of time the
subscriber spent on the network.

Schiller said in his ruling that the plaintiffs might have
had trouble proving damages, as the average AOL
subscriber actually doubled usage to 14 hours per
month after the pricing change. He noted that AOL
had informed subscribers about an expected surge in
demand.

The company has not specified the cost of resolving
the nationwide class action.
