A LEGAL immigrant. Not a criminal. IIRC he filed papers show an INTENT to immigrate, and at that time we had no legal impediment.

It is a different thing since the 60s, when LBJ discovered we needed a law to control immigration from across the southern border or people would take advantage of the situation.
