IMHO I think your reading to much into it. There have been numerous credible posts on this thread supporting Joe's original position on the patent application. What I find curious is how easily he was pushed into proceeding with the PA. Has he got his money lined up? Or?
I wouldn't have thought it would take much to fight that part of the subpoena, but I could be wrong. Someone with more knowledge and experience in that area might give us an opinion.

The potential down side on BAAT is limited to $0.70. The potential up side is very large. Two weeks ago they demoed a 95 MPG car.

Anyone who doesn't like the odds on this one should have their money in the bank.

I've been over BAATs web site and could not find the "quote" mentioned. There is a reference to *deep pockets* in the news page in association with patent protection, but no quote from Joe. IMHO you have been fed a line of...well, perhaps it is a post from a USA Today reporter bucking for a raise.

One of the problems with the whole patent process is that you must publicly disclose your intellectual property. You are then at the mercy of anyone who wants to attack your position by claiming, accurately or not, that they have a prior position in your claim area. This problem is particularly acute for small companies who can be financially swamped by legal fees in attempting to defend their position. Like so many other facets of our legal system, whoever has the most money wins the contest.

A common strategy adopted by small innovators is to enter into an agreement with a much larger entity, or "deep pockets", in order to have a strong ally to help defend potential claim jumpers.
