You're correct, but it also makes him part of the "control group" for the purposes of asserting attorney-client privilege, and the shield afforded by attorney work product. The control group test for attorney-client privilege is a restrictive one not used in a majority of jurisdictions, but this agreement will likely afford protection even if it's applied in any litigation, whether based in Texas or any other state.
