This is a very old debate, dating back to late 19th century.

The US banned bucket shops about 100 years ago. Was the ban reversed or did the prop shops find a loophole?

If it was reversed, then CME will have a hard time getting anywhere with this argument. But if the prop shops found a loophole, then CME should be able to argue they are doing an end run around the law.

This should matter to anyone who has money on the line because I doubt prop shops will pay up if they have to close shop.
