Trump is leaving it up to the states. Which is in accordance with our Constitution. "Always mindful of the need to set limits, the Framers designed the Constitution so that the states would give specific powers to the federal government, not vice versa. The Tenth Amendment therefore says that any powers not directly given to the federal government “are reserved to the States respectively, or to the people.” In other words, the states are assumed to have powers that are not given away, and the federal government has only the powers it receives and that are enumerated, or listed, in the Constitution.
