Dear Kathy: I dont understand your problem. Will DLJ allow you to buy TAVA on margin if you use the phone to order? If so, that seems reasonable. If you are saying they told you it was marginable and after you bought said it was not and made a margin call that is another story and if necessary you may need to go to arbitration on the matter. Personally, if the latter is true and you can establish that they in fact said it was marginable I would think you would be successful in an arbitration hearing. JDN

DLJ Direct has been difficult for me too. On the 18th, the day of the symbol change, I had no problem buying on margin (over the phone) but, strangely enough, when I sold that afternoon the representative was adamant that the stock was not marginable. On Friday, I again had no trouble buying on margin. It seems that the left hand doesn't know what the right hand is doing at DLJ Direct! Until this mess is straightened out, there's no way I will attempt a TAVA margin trade on line.

Just got off the phone. I threatened to pull my entire account. Two supervisors got involved. Profuse apologies given at least 4 times!!

Initial calls started off with the canned NASDAQ blah, blah, blah stuff. I said if it was NASDAQ who reversed marginability, I wanted WRITTEN confirmation attesting to this. And then I put a SELL order in (MORE than what I had on margin), which they ultimately cancelled ... because they understood why I was doing it, and it was no longer necessary.

According to DLJdirect, TAVA is now "officially" marginable. Confusion most likely occurred because of name change. In computer system now, should be reflected tomorrow.

George will HATE me giving out his name, but if anyone has a problem, ask for George Shannon.

P.S. George is a very nice guy. I'm sure he wasn't looking forward to calling me. Probably thought I'd be a real b*tch. But, I was sweet as sugar.
