My understanding is yes that is not able to be litigated any further, even in their counter suit. However remember that was about ARM breaching Nuvia's TLA.

Now that Qualcomm owns the CMN IP and Booker IP perhaps its yet another violation of Qualcomm's TLA/ALA that they're still using it. And that's how they're going to litigate it if they are preparing to do so.

I believe the more realistic view on this is that litigating this was too dangerous and close to what Arm was claiming Qualcomm did? If they were prepared to litigate that then it may risk losing the big picture question (QC is properly licensed under their ALA). Perhaps they chalked it up to "doing business" in order to secure the more important ruling.

In reality we need to wait for the redacted claims, should be out the week of the 6th I assume, there was another request to extend timing for that release due to the holiday season.
