Whichever controller (tower or ground) told him to hold short had an obligation to visually confirm he was complying.

The "Hold Short" lines are far enough back from the runway that a pilot error can be observed by the controller in time to intervene, by re-iterating the "Hold Short" command, or by telling the landing aircraft to go around.

In most cases, the controller can tell whether an aircraft is slowing as it approaches the line, or if it's going to keep going.
