A couple of truth bombs about today's decision by SCOTUS on the TRO issued by Judge Ali: The DOJ never appealed the original TRO entered by him. Rather than do that, they opted to "maneuver" around thru a hole he left in his order that allowed them to rely on statutes/regs/ contract terms to delay making the payments. Right or wrong - they didn't appeal his decision outright, which is one of the things the Plaintiff's pointed out to the Supreme Court. The only appeal was of his Feb. 25 Order that the payments be made by Feb. 26 at 11:59 pm. Second, Roberts stepped in when there were 2 hours left and there was much uncertainty about whether the payments could be made as directed by Judge Ali on a logistical basis. That issue is dealt with by today Order. Judge Ali is directed by the Order to be specific about what claims his order covers and he needs to consider the logistical problems of making the payments in fashioning a new order. "Given that the deadline in the challenged order has now passed, and in light of the ongoing preliminary injunction proceedings, the District Court should clarify what obligations the Government must fulfill to ensure compliance with the temporary restraining order, with due regard for the feasibility of any compliance timelines." The Govt will surely appeal any subsequent order that directs it to pay parties who are not before the Court. So, don't read more into the Order than is there. Yes, it would have been nice for the Court to simply vacate the TRO. But that would not have solved the problem. As the Order notes, the Preliminary Injunction proceedings are ongoing. The briefing on that is complete and a hearing was supposed to take place yesterday. I expect Judge Ali will now hold that hearing since his TRO expires on 3/10 -- 5 days. The jurisdictional issues are raised in the briefing so Judge Ali is going have to confront them as part of any decision he makes. None of that was before the SCOTUS in a properly briefed form. Roberts always prefers regular order. He stepped in because the order to pay by 11:59 that night was the problem. The other issues can all be dealt with in regular order -- let Judge Ali enter his TRO, the Govt appeals the TRO to the Circuit Court, and then the case gets to SCOTUS on the merits. New Method Emerges To Allow Trump, Elon And DOGE To Move Even Faster... Elon Musk is considering a new plan that could prove to be a total game changer for speeding along the process of cutting back government waste. The plan was proposed to Elon Musk by Sen. Rand Paul during a lunch on Wednesday. Paul pitched the idea of a huge ‘rescission package’ to Elon. The package would scale back tens to hundreds of billions of dollars in federal funding that has already been approved by Congress. And, here’s the real kicker — it would only require 51 votes in the Senate to pass. With 53 Republicans currently in the Senate, this means that even if not a single Democrat voted for the package, it still has a great shot at passing! Elon Musk was “elated” at the idea, according to Sen. Josh Hawley who also backs the proposal. Other Senators who have already given their support include Sen. Eric Schmitt, and even Sen. Lindsey Graham. NBC News dove deeper: Elon Musk met with Senate Republicans for nearly two hours in a closed-door lunch meeting Wednesday, seeking to reassure them amid voter anxiety over the sweeping cuts his Department of Government Efficiency is making. They discussed a “rescission” package that the White House could send to Congress to codify his cuts through a measure that can get around the 60-vote hurdle in order to get around legal challenges to the administration’s power to act unilaterally. “To me, it’s ephemeral now. I love all the stuff they’re doing, but we got to vote on it. So my message to Elon was let’s get over the impoundment idea, and let’s send it back as a rescission package,” Sen. Rand Paul, R-Ky., told reporters. “Because then what we have to do is lobby to get to 51 senators or 50 senators to cut the spending.” Multiple senators said Musk was surprised to learn there was a viable legislative pathway to making DOGE’s cuts permeant. Sen. Lindsey Graham, R-S.C., said Musk was “so happy” when he heard the news, telling reporters that Musk pumped his fists and danced. He backed the idea Paul raised. “It’s time for the White House now to go on offense. We’re losing altitude. You know, we started off straight good,” Graham said. “We need to get back in the game on offense. And the way you can regain altitude is to take the work product, get away from the personalities and the drama, take the work product and vote on it.”

It was so shocking, so unbelievable, some days I questioned my own reality… I never thought the media I knew and trusted would turn on me like that, and for what? An election? For politics? Surely not… surely people suffering would overrule any political decision these media outlets would make, right? No. It was all a lie. Everything I thought I knew about the media, about politics, it crashed to the ground and shattered.
