I have personal experience with the issue, as I had to retain a trademark lawyer some years back when a competing company used my company's name, with the addition of some punctuation. They needed to prove I'd abandoned it for two years.

It was a tough one for them because my then-current most visible presence was in a local computer rag on an ongoing monthly basis. Hmmm.... Unfortunate combination of a few words there, but too lazy to revise.... :)

Anyway, like in this situation, it would've been tough to find the name before they started using it, but when I took them to task for it, they had to prove not that it would've been difficult, but that it would've been nearly impossible.
