A "cease and desist order" is nothing more than the first volley.

The company can counter by ceasing and desisting, stating they have the legal right to use the name, or making an offer for those rights.

That is, unless I'm not understanding the phrase correctly. In my own situation, my lawyer sent a letter demanding they "cease and desist" using the name. If that order came from a judge, though, I'm sure it'd be a different story.
