I know you’re a lawyer, as was I (judge now), and thus pay close attention to words like these.
However, I would suggest that most people do not, and that the 8-k response does not read to me like it was written by a lawyer. I accordingly would not make that assumption. (And I’m generally not one to give the benefit of the doubt!)

My only quibble with your observation of the perhaps intentional obfuscation via small but potentially misleading word choices in the release is just that: it is more clever than I believe they are. Now YOU would think of such a thing if you were there lawyer but I just can’t assume they are that clever.
