It's going to be appealed, so this is just step 1. I mentioned this case a couple of weeks ago, so it's been on the radar.

What I'd like to know is if this gets appealed all the way to the Supreme's and remains overturned, what happens to all the tariff money that's already been collected under unlawful grounds?

Companies will likely need to file to get refunds from the Department of External Revenue.

Most of the $22-billion already collected in May for April tariffs will have to be refunded to the companies who paid it.

Bonds won't like that one bit.

Holy crap! The court issued the ruling on Summary Judgment! That means the grounds upon which the tariffs were levied are so wrong that it's likely no court of appeals can or will reverse this ruling!

Good lawyers try to use Summary Judgment to get cases dismissed quickly. It rarely works in legit cases where there is doubt as to the outcome if the case played out in court.

There was definitely no doubt whatsoever as to the legality of the tariffs. They're not legal according to the CIT.
