The most key term in the Alien Enemies Act for present purposes is “predatory incursion.”

If Congress had intended “predatory incursion” to have the same meaning as “invasion,” it would not have been redundant and separately put the “predatory incursion” term into the Alien Enemies Act.

Any American with an average grasp of English would say without hesitation that if a violent gang member from Tren de Aragua or MS-13 crosses the U.S. border illegally to engage in crime, such a gang member is engaged in a “predatory incursion.”
