Technically the crown owns it now and we have a fee simple landholding, so we can buy sell hypothecate, but the crown really owns it (just doesn't appear that way, due to the fee simple). If the First Nations takes over the crown's position only, then we can still buy sell hypothecate and still have the fee simple title, except with First Nations and not the Crown.. So it would be a change, for example, of who we pay property taxes to. If First Nations decide to do something else, like totally abrogate and get rid of people's fee simple title and say those titles have no standing in law, then the home and land would be worthless to the current owner and I think people would be able to sue the Crown, since they sold a title for which they had no right and the homeowner suffered damages (loss of the home/land). But based on what I've seen various First Nations say, it doesn't look like they plan to abrogate the existing fee simple titles. FWIW! Needs much more clarity from both parties.
