Yes, none have kept up with Qualcomm as to innovation but that wasn't my main point. Apple has always played the game of bring to market product based upon recently expired (or expiring soon) patents.

Cook expected cellular phone technology to plateau somewhat and that was the basis for his getting on-board with modems. Once aboard, he will follow along within the parade at a distance where he can get away with patent usage due to pending expirations.

Is it at all cost effective? Likely not, but when one has as much money as Apple and is incapable of leading otherwise, it's all just becomes another factor in the marketing of one's product (ie differentiation of message).

ps Backwards compatibility is solely based upon older patents. Forward steps is all that really matters. It's the lawyer's job to take care of infringements of yesteryear.
