He wasn't justified per the DOJ. He's leaning over the hood out of the way of the car when he fires the first shot. Which missed it was to the left of the driver. The second and third shots to the head were the kill shots after the car was passing him.

Watch this, as hard as it is. Many of you have been told this law enforcement officer wasn't hit by a car, wasn't being harassed, and murdered an innocent woman.

The reality is that his life was endangered and he fired in self defense. x.com

The officer's off to the side of the car when he shoots the windshield. The sound and the abrupt movement in the camera is because he's holding it in his hand as he grabs the hood and pulls out his revolver. His camera's view is off to the side of the grille of the car before the commotion which indicates that he's also off to the side. I'd give it a 90 percent that he wasn't hit by the car. Other views clearly show him leaning onto the car with his hands and his body away from the car, indicating that he tried to grab onto a car that was evading him.
