Dude, he was leaning over the hood to the side of the car that just brushed him when fired the first shot, which missed. The cars wheels are turned away from him. The car is moving away from him not toward him. The second and third shots were the kill shots to the head through the side window. That's murder.

Read the law again.

He was at the side and the vehicle was clearly moving away before he fired the first shot. Which is why you see him leaning forward to fire through the windshield.
