You are right. It is a crime scene until it is determined to be otherwise. And yes, shooting someone makes it a crime scene.

The determination that it wasn't a crime is not made until an investigation, however brief, is made. And the agents in question fled before that was done. ICE has a habit of tampering with crime scenes and evidence. Like when they moved the car that other woman was shot in to another state. Not to mention, ICE has had cases thrown out when the judge realized they were lying in court.

Something you might want to factor in when you are fanwanking defenses.
