This issue as to which entity is the proper defendant suggests an effort ARM to buy time for settlement negotiations specifically an attempt to narrow the differences between the parties by adding a time dimension. ARM's settlement position with the extension now granted would be that Qualcomm's demand should not be x but rather the present day value of x paid out six months from now or even a longer time period if ARM has other stalling techniques up its sleeves ((pardon the pun). But I must say that Judges usually hold firmly to trial dates to force the parties to settle but this Judge has decided to leave the parties in limbo for the time being.
