I was asked to post my slant on the Bunte trial. I was not sure exactly what to write until a friend asked me if I thought Bunte was actually guilty or "COULD" he be just the fall guy?ÿ This is what I wrote back to them, which I feel says where I am with this whole affair.

I agree that too much time has elapsed to be perfectly clear on
everything and every detail.ÿ My take on this is simple, 1. Is Bunte guilty of anything?ÿ "Yes", the question is "of what???".ÿ That I don't know. At the least, as you said, he may have been sucked in at the beginning and then things got out of hand. That in itself is still wrong, he knew that the company didn't have an endless supply of cash, and for him to "take a loan for the amounts that he did", no matter how he plannedÿ to repay said loan, was damaging to everyone. At worst, he and "K" and "?", had a well planned out play that they acted out scene by scene, line by line, and he is using his " I'm just a simple victim like everyone else" character, in trying to
get the lightest punishment possible. At this point I just do not know. The one thing that I will say is, that if the jury finds him innocent then I will give him the benefit of the doubt and at that point will say that the only thing he is guilty of is being stupid.ÿ 2. Was "B" or "K" the mastermind?ÿ I feel that at this point, "K" was definitely the mastermind. He has already plead guilty so yes he is a crook. I have no doubt that he rolled over to try and get himself a lighter sentence. Would he say that "B" is guilty, when just maybe he isn't, you bet. Would he tell any lie that he thought the investigators wanted to hear, again, with out a doubt. Would he
do anything that it took, no matter how low or dishonest, I would stake anything on that bet. But, is he??ÿ Or is he now telling the truth, not wanting to take the fall alone while his cohorts run free and continue there lives?ÿ That, only the jury will decide and I will abide by what they find to be the truth. I just refuse to make an actual judgement call right now as there are still too many unknowns, too many characters still unaccounted for, too, too many unanswered questions?
ÿÿÿÿÿÿÿÿÿÿÿ I hope that this gives you a feel for where I stand right now. As too your other question, No, we were not allowed to be in the courtroom except for our testimony. The judge felt that if we were to sit in there while others testified, that it might just influence the jury by watching us and our reactions, and "B" would not get a fair trial. I'll tell you this, I wished with all of my being that we could have though.

Cindy, Ken said that he didn't know if you got the picture that he tried to forward to you or not. If you did not get it or were not able to view it, write me privately and tell me what formats you can view and I will resend it directly to you. BTW, great picture of yourself :-)

To All:

This is a great link to the Trial. Be sure to bookmark it because Mike Pollick will be updating it as the trial continues.

This is my attempt to convey to you my thoughts on the trial while I was there. I am no writer but will try to let you know the gist of the Defense strategy and the Prosecution side. I was not able to hear the opening arguments but my wife was there and she is helping me with this.

Mr. Mike Runyon, the lead Attorney explained to all of us that each had a piece of the puzzle and his job was to pull all these pieces together. It seems that the Defense is saying that Bunte was an innocent victim of Klenovic. Klenovic was the "brains" of the outfit and that Bunte only did what he was told. The Defense says that Klenovic and Arata would write the news releases and have Bunte sign them. It seems that they are saying that Bunte was too dumb to know what was going on.:-)
Klenovic couldn't have his signature on any of this because of his prior record and he was using Bunte to do his dirty work.

My wife and I had to leave before Klenovic began his testimony but I am sure that Mike Pollick of the Sarasota Herald-Tribune will keep everyone up on this. I had the pleasure of meeting with Mike and he is a fantastic reporter.

We met Doe Baker who also testified. She was Bunte's secretary. She typed the press releases that Bunte composed on info given him by Klenovic and Arata about the new product. Arata would proof and make changes as he deemed. Doe Baker stated she had seen the water purification product but never had seen the Microsafe product and only knew what was told to her about it. She answered the phones and gave calls to Bunte from potential investors with questions to Bunte. She admitted under cross examination that Klenovic and Arata appeared to be the brains behind Bunte.

My piece of the puzzle was to tie the Internet to NVID and some of the news letters that were available. I won't mention the two news letters or their authors.:-) Laura Royal and I set up the demo using my passwords and user id's to show the Jury how we get on to research stocks. I used my portfolio's on Quote.com, Yahoo Finance, and Silicon Investor to show how we swapped info and ideas. The Defense would not let us use the NVID thread so I set up another thread and had people standing by to help us show how we could almost have a "live" chat using the SI Threads. I felt like after this demo that the Jury had a good understanding of the Internet and how the news services could be used by someone to spread a lot of hype such as what NVID did.

William Brotherson (Bill) did an outstanding job telling of his contacts with Bunte, Klenovic and others trying to confirm the place Microsafe would have in "solving" the Bee problem. I'll let him tell you about his testimony. I just want to repeat that he did a great job.

Mike Conticelli really had an important piece of the puzzle. Mike had tapes of a radio talk show that he had taped with Bunte's explaining the "miracle" product. Again, I will let Mike explain all that to you.

I really felt sorry for a Mr. Storey who testified. He lost a lot of money ($58,000) and was very emotional about it. I had the pleasure of meeting Mr. Storey and his wife, and it would really make you mad to hear of the conversations between the Storey's and Bunte and all the things he told them. It really became clear to me the extent of the lies and treachery that this group of people went to rob people of their money. I really feel like there never was any truth to any story that these people told.

Good luck to all,

Ken Moss
