Well, that whole deal was a little on the shady side and I believe is still being investigated. However, the real difference in the efficiency of the different frequencies is not near what you imply.

I'm not near a technical wiz here but I do think the FCC did the neccesary calculations and that that is why they have decided that one channel at 38 GHz will be equal to 100 MHz and that one channel at 24 Ghz is equal to 80 MHz.

I believe this means, and it is backed up by some technical analyses I've seen, that 80 MHz of bandwidth at 24 GHz is equal in capacity to 100 Mhz at 38 GHz.

So you are right, we're not talking direct apples to apples, however it's pretty close. WinStar probably needs 1.25 times Teligent's bandwidth to be considered equal.
